By using our Services, you are agreeing to these terms including any subsequent changes or modifications. Please read them carefully. If you do not agree to these Terms or our Privacy Policy, please do not use the dscribers.com website or any of our Services and products.
Personal Data
Personal Data is any information that relates to an identified or identifiable individual. The Personal Data that you provide directly to us through our Sites will be apparent from the context in which you provide the data. In particular:
When you register for a Dscribers account we collect your email address, IP Addresses, and account log-in credentials.
When you fill-in our online form to contact our sales team, we collect your full name, work email, and anything else you tell us about your project, needs and timeline.
When you respond to Dscribers emails or surveys we collect your email address, name and any other information you choose to include in the body of your email or responses. If you contact us by phone, we will collect the phone number you use to call Dscribers.
Collected Information
We also may collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps and other online features and services. We use Google Analytics on our Sites to help us analyze Your use of our Sites and diagnose technical issues.
Website Use Permit
You may use the website and the information and material to upload files and edit, share, and export them on a non-exclusive basis. Except for audio files that you have personally uploaded to your Dscribers account,
You must not republish material from this website (including republication on another website) or reproduce or store material from this website in any public or private electronic retrieval system.
You must not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit our website or material on our website for a commercial purpose, without our express written consent.
You must not use any photographs, graphics, videos, or audio sequences separately from any accompanying text.
You must not alter, decompile, edit, or otherwise modify any material on the website.
For general purposes, we grant you a license to use any software applications included on the website. Except as permitted by applicable law, you may not translate, adapt, change, modify, distribute, decompile, or reverse engineer the program for any purpose, create derivative works based on it, integrate it with other software, offer access to it, or use it to provide services to third parties. Without our prior written consent, you may not use the software as specified in these terms. Your use of any assistance, software, information, and materials available on the website may be subject to additional terms and conditions that Dscribers will notify you of when downloading or accessing.
Your download or use of such services, information, and materials will indicate your acceptance of those additional terms.
Transcription Precision
Dscribers guarantees a 98% accuracy rate for only “good” audio with up to two people in the recording. Should the client feel that any work performed by the vendor does not meet this accuracy rate, the client must contact us at info@dscribers.com. Within two (2) weeks of receiving the transcript(s). The client accepts and understands that no transcript is ever “perfect.” Sometimes, judgment calls must be made, and the client realizes this. Should the client feel that the accuracy rate is below 98% and the audio is deemed “good” quality, Dscribers will review and correct any validation errors (s) and return the transcript as soon as possible. No corrections will be made on orders with audio files deemed or uploaded to us as difficult-quality audio. The client understands that Dscribers holds a no-refund policy.
Dscribers charges per minute of audio, not by page count, number of characters, or words. This prevents unnecessary expenses that many other companies will incur. Any “part” of a minute at the end of an audio file will be rounded and added to the next minute only if the “part” is longer than 10 seconds.
Due to different versions of MS Word and computer compatibility, we will do our best to follow it as closely as possible if you request special formatting or a template to be used. However, we cannot guarantee that it will be exact or mimic your original template or example precisely.
Turnaround Time Terms and Conditions
Turnaround times are based on business days.
Any uploads with the same-day service turnaround time must be uploaded before noon Pacific Time (Monday through Thursday) to receive them the same day. If not, we will address your file the next morning. Friday uploads for Same Day Service or 24-hour turnaround time that arrive after noon Pacific Time will not be processed until Monday. Any files with the Same Day Service or 24-hour turnaround time uploaded over the weekend will not be processed until Monday.
Any uploads after 4:00 p.m. Pacific (Monday–Thursday) will not be processed until the following day.
Any uploads after 4:00 p.m. Pacific on Fridays will not be considered for processing until Monday morning. (Please see above regarding Same Day Service times.)
Although we rarely return transcripts later than the turnaround time requested, any files submitted as Same Day Service, Next Day Service, or over 30 minutes are not guaranteed to be completed by the turnaround time selected. Any files submitted for a 1-2 day, 3-5 day turnaround time and over 100 minutes are not guaranteed to be completed by the turnaround time selected. Any text files submitted for a next-day turnaround time and over ten pages are not guaranteed to be completed by the chosen turnaround time. The initial rate will remain for these large duration files even if there is a delay. We will do our best to get them done for you as soon as possible.
Chargeback & Refund Policy
Dscribers will not, under any circumstances, issue cash refunds for any orders. If you have a question about an order, please contact us immediately. Dscribers reserves the right to suspend and/or terminate a customer’s account any customer who disputes a credit card payment that is found to be valid will. Any past due fees and costs will be sent to collections. If our collection efforts fail, unpaid debts will be reported to all available credit reporting agencies.
Fees
To use the services, you must make one or more payments and provide Dscribers information regarding your credit card or other payment instruments. You represent and warrant to Dscribers that this information is accurate and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay Dscribers the amount specified in the service per the terms therein and this agreement. Prepayments are non-refundable and can only be applied to future services. The customer is responsible for any wire transfer fees. All fees specified herein are denominated in United States dollars unless otherwise specified.
A) Invoice
Dscribers may choose to bill through an invoice, wherein full payment for invoices issued in any given month must be received by Dscribers thirty (30) days after the mailing date of the invoice, or the services may be suspended. Unpaid invoices are subject to a finance charge of 1.5% per month on any outstanding balance or the maximum permitted by law, whichever is lower. If you dispute any charges, you must let Dscribers know within thirty (30) days after the date that Dscribers invoices you.
B) Pricing
We reserve the right to change Dscribers’s prices at any time without notice. Dscribers’s pricing will be reflected on the site. Your continued use of the service after the price change becomes effective constitutes your agreement to pay the changed amount.
Duplicative Uploads
The customer acknowledges and agrees it is responsible for duplicate content uploads or incorrect service type selection.
C) Taxes
All amounts payable hereunder by the customer are exclusive of any value-added, sales, use excise, or other similar taxes (collectively, “Taxes”). All applicable taxes are solely the responsibility of the customer.
Privacy
Dscriber’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Dscribers can use such data in accordance with our privacy policies.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the U.S. Digital Millennium Copyright Act.
Privacy & Communications
You acknowledge and agree that Dscribers LLc may occasionally send you communications regarding your account or the Service via email.
You can control the email notifications from your account settings page. There may also be direct communications from our support executives whenever we have to follow up or have questions regarding your files. See the Privacy Policy, which is incorporated into this Agreement by reference.
Security
Dscribers cares about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your data for improper purposes. You acknowledge that you provide your personal information at your own risk.
Agreement
“Client” agrees and understands that checking the box to agree to terms and conditions, or terms of service (TOS), binds the client to the terms of service (TOS) listed here. dscribers holds the right to change or modify this Terms of Service (TOS) agreement occasionally. Any modifications or changes made will appear on the www.dscribers.com website.
Termination, Suspension, and Term
A) Term
The term of this agreement will commence on the date you begin using the service and will continue as long as you maintain a Dscribers account unless terminated by either party following the terms of this agreement. Either party may terminate this agreement upon 30 days’ written notice to the other party.
B) Suspension
Dscribers reserves the right to suspend a customer’s or any end user’s access to the platform in the event of an emergency security issue. Rev will make commercially reasonable efforts to limit the suspension to the minimum extent and duration necessary to eliminate the emergency security issue. Dscribers also reserves the right to suspend or revoke any End User’s access to the platform if they violate this Agreement or any Policy.
C) Termination for Cause
This agreement may be terminated as follows:
(i) by the non-breaching party upon a material breach of this agreement by the other party, which breach is not cured within thirty (30) days after receipt of written notice from the non-breaching party; or (ii) by either party in the event the other party becomes insolvent or bankrupt; becomes the subject of any proceedings under bankruptcy, insolvency, or debtor’s relief law; has a receiver or manager appointed; makes an assignment for the benefit of creditors; or takes the benefit of any applicable law in force for the winding up or liquidation of such party’s business.
Events Upon Termination
If this agreement expires or is terminated for any reason, (i) all rights granted by the parties will immediately terminate, and (ii) the customer will immediately cease all use of the platform made available under this agreement. Upon the expiration or termination of this agreement, each party shall cease all use of the other party’s confidential information and, upon written request, destroy all copies of such personal information in its custody or control. Notwithstanding the termination of this agreement for any reason, neither party will be relieved of any duty, obligation, debt, or liability that arose or accrued before the effective termination date. Within 30 days of termination, Dscribers will return any prepaid, unused fees.
Conditions
We reserve the right to modify these Terms of Service at any time without notice. Please review these Terms of Service on occasion as they may change in the future. We may, but have no obligation to, remove accounts and content containing what we determine, in good faith and on reasonable grounds, as unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable material. We will remove content that violates any party’s intellectual property, if we have been notified of such violation, or these Terms of Service. An account terminated by Dscribers will not be backed-up for any reason and will be immediately deleted from our servers.
